By using MDandMe, you agree to these Terms of Service. If you do not agree, do not use the service.
Service Description
MDandMe provides a conversational AI for medical interviews It is not a doctor or a licensed medical profession. It is not a substitute for professional medical advice or treatment.
As part of the service, you may be asked medical question and provided medical information that may be relevant to your health. It is your responsibility to verify the accuracy of this information and to consult with a healthcare professional if needed.
User Responsibilities
Users should not rely solely on MDandMe for medical decisions. Always consult with a healthcare professional.
Age requirement
By using this service, you represent that you are at least 13 years old or older. If your local jurisdiction requires a higher age of consent to use this service, you must be at least that age.
Disclaimers and Limitation of Liability
MDandMe is provided "as is". AuxHealth Inc disclaims all warranties and liabilities to the fullest extent permissible by law. We do not form a patient-doctor relationship.
In no event will AuxHealth be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of MDandMe, even if AuxHealth has been advised of the possibility of such damages.
Intellectual Property
All content and technology associated with MDandMe are the property of AuxHealth, Inc. Unauthorized use, including data scraping, decompiling, or reverse-engineering, is strictly prohibited.
User Data and Privacy
Our use of your personal and medical data is governed by our Privacy Policy. Please refer to the policy for detailed information on data handling.
Publicly Shared User Generated Content
MDandMe allows users to share content publicly within the community. When sharing content, users must adhere to our community guidelines. The following types of content are strictly prohibited:
- Harassing or bullying content
- Hate speech or discriminatory language
- Explicit or inappropriate material
- Spam or excessive self-promotion
- Content impersonating other users or medical professionals
- False or misleading medical information
Users who share prohibited content may have their content removed and may be banned from using the service. MDandMe provides a reporting system for users to flag inappropriate content. We also employ automatic filtering systems to detect and block potentially abusive or inappropriate content. However, these measures may not catch all instances of prohibited content, and we encourage users to report any concerning posts or comments.
MDandMe reserves the right to remove any user-generated content, suspend or terminate accounts, or take other appropriate actions at our discretion to maintain a safe and respectful community environment.
Payment and Premium Services
Premium services are available for an additional fee. Payment processing is handled securely through Stripe. If you choose to cancel your subscription you will be provided services until the next billing cycle. Unless you cancel your subscription, you will be charged automatically. We do not provide refunds.
Modifications to the Service
AuxHealth, Inc reserves the right to modify or discontinue the service at any time without prior notice. We will not be liable for any damages or losses resulting from such modifications.
Termination
Users may terminate their use of MDandMe at any time. AuxHealth, Inc also reserves the right to terminate access to users who violate these terms, without notice, if your use of MDandMe is deemed harmful to AuxHealth, its users, or any third party. In addition, we also reserve the right to refuse service to anyone for any reason at any time.
Governing Law
These terms shall be governed by the laws of the United States and the state in which AuxHealth, Inc is registered. You agree to submit to the exclusive jurisdiction of the courts of the state of Delaware, United States.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms, and the remainder of the provisions shall continue in full force and effect. The parties agree to replace any invalid or unenforceable provision with a valid and enforceable provision that achieves, to the greatest extent possible, the economic, legal, and commercial objectives of the invalid or unenforceable provision.
Changes to the Terms of Service
AuxHealth reserves the right to modify these Terms at any time without prior notice. Your continued use of the MDandMe services following any modification of these Terms constitutes your agreement to be bound by the modified Terms. If you do not agree with any modifications to these Terms, you must cease using MDandMe services immediately.
